Ken called the meeting to order at 7PM.
Ken shared that there is no new information to share on the lawsuit.

Balances: As of 1 April, the Operating Fund had a balance of $30,153.37, and the Reserve Fund (savings) has a balance of $36,202.57. The Community had received $ in dues, including one prepayment of 2023 dues, leaving $37095 in dues and late fees still outstanding.

Dues: As of today, 62 households have paid their 2022 dues in full, with two household paying in installments, and 5 households still to pay. Note that assessments were due by 1 April, and late fees and interest will accrue beginning 15 April. Dues are $720, payable to Mar Cheri Community Club, and they must be paid for a household to be in good standing.

Operations: The Community has paid an additional $1535.41 in legal fees. As of 1 April, the Community has paid $6138.89 in legal fees since the start of the year. As reported last month, all of these fees have been submitted to our insurance for reimbursement. Reimbursement seems likely, as the insurance company has recognized our claim and has taken over representation of the community. This should also reduce future legal fees in connection with the lawsuit.

Because of the broken pipes at the pool in January, the community filed a claim and has received a check for $3278.69. The insurance company will pay an additional $285.27 when they receive verification that the work has been completed. Any additional repair costs not covered by insurance will be paid for from the Reserve, as the plumbing and the pool house are within the scope of the Reserve (we can spend Reserve funds to maintain them).

We have worked with Lakehaven Water to get an adjustment to our bill because of the leak. In the end, we will owe about $400 for that month (instead of the $2800 originally billed).

Our current insurer has notified us that they will not renew our policy for the coming year (effective June). Our broker is helping us find new coverage.

Reserve: The community spent $1833.98 for new pool furniture. The work to repair the pool house plumbing is complete, and the bill for $4400 will be paid in April (so it is not reflected in the March reports). This will come from Reserve as well. The quarterly reserve payment of $4000 has not been made. The Community is delaying making its Reserve payment until the ongoing legal matter is resolved.

Rod’s report was given by Lisa Martinez.
Rod reported that part of the work is not completed at the pool house, and that we are waiting for the contractor to be available so the work can be finished.
Rod also shared that it may not be possible for us to have a work party this year. He will have a list of the tasks that need doing and you can contact him at: maintenace@marcheri.org in order to Learn what needs doing and see how you might help. Again, thank you for helping your community by volunteering to serve in this way. This really provides a huge savings to the neighborhood.

Lisa reported that there was one new request made of the architectural committee: they are looking into the matter.

Mar 2022 — Minutes for the Monthly Meeting of the Board of Directors of Mar Cheri Community Club

Ken called the meeting to order at 7:01 PM.

He called for a motion to accept the minutes from the 2022 annual meeting. Gary made a motion that the minutes of the Mar Cheri Community Club Annual Meeting of Members be accepted as written. Rod Martinez seconded the motion. The minutes were unanimously accepted.

Ken stated that the attorney for the community, David Huhs, has turned over our legal case to our insurance company who will now handle the matter.

Balances: As of 1 March, the Operating Fund had a balance of $13,608.87, and the Reserve Fund (savings) has a balance of $36,200.80. The Community had received $13925 in dues, including one prepayment of 2023 dues, leaving $37095 in dues and late fees still outstanding. 

Dues: As of today, 19 households have paid their 2022 dues in full, with two household paying in installments, and 48 households still to pay. Note that assessments are due by 1 April, and late fees and interest will accrue beginning 15 April. Dues are $720, payable to Mar Cheri Community Club.

Operations: As of 1 March, the Community has paid $4603.48 in legal fees since the start of the year. All of these fees have been submitted to our insurance for reimbursement. Reimbursement seems likely, as the insurance company has recognized our claim and has taken over representation of the community. This should also reduce future legal fees in connection with the lawsuit. 

Because of the broken pipes at the pool in January, the community filed a claim and has received a check for $3278.69. There are several factors that impact the relatively small insurance payment against the total cost of the work at the pool. First, the community has a $1000 deductible against any claim. Second, the insurance depreciates the property damaged, and the pool house was due for renovation next year. Third, we are using the opportunity of opening the pool house walls to replace all the plumbing, not just the leak. Since the pool house is within the scope of the Reserve, repairs and renovation can be funded from there, which means that there is less immediate impact to the budget, though it will impact ongoing Reserve needs and funding levels.

Reserve: As of 1 March, the Community had spent $3670 from Reserve on the water leak. The remainder of the cost of the renovation, as well as the cost of pool furniture, will impact the budget in March, and so are not included in these February figures.

Anne shared hand written comments included with the ballots. Many property owners thanked the board for their work. A couple property owners were concerned that there was little information on the legal fees. In response to those comments; this case is ongoing and the board has been asked not to discuss any aspect of the case.

Maintenance/Pool: Rod Martinez

Rod reported on the progress of the remodel at the pool house. The plumbing is complete, and there will be one more testing of the system once the toilets are reset. He is awaiting bids on the drywall work. The walls will need painting when the drywall is complete. The wood ceilings are in good condition, but the light fixtures and the exhaust fans need replacing. The attic has several large openings that need plugging (not related to the leak); this will be completed when the drywall is repaired. Insulation will be installed in the attic space and the exhaust fans will be properly vented. The project is on schedule for completion before the pool opening.

The new furniture is purchased and a few new umbrellas will be added to replace those that are worn out.

Lisa had one inquiry about a roof that should be finalized soon.

New Business:  The pool will open for the season on Friday, May 27, 2022.

There will be a work party to complete tasks necessary for the opening of the season.

If you are unable to join the work party, Rod has a list of projects needing to be completed. Your help is appreciated as it not only gets the work done, but it saves the community money. More information will be provided on this in the near future.

Feb 2022 — Minutes for the Monthly Meeting of the Board of Directors of Mar Cheri Community Club

Ken stated that there is nothing new to report on the law suit.

Note: Numbers reported this month use the proposed 2022 budget, awaiting membership approval. 

Balances: As of February 3, the Operating Fund (checking) has $2379.50, and the Reserve Fund (savings) has $39,869.78. The Community has received $720 in dues, leaving $48115 still outstanding.

Operations: January had very little activity in the Operating Fund, with $195.14 spent. Looking ahead, there are legal bills totaling over $2000 pending for February.

Reserve: The Community has spent $3670 from the Reserve to repair a water leak in the pool house and the line leading to the pool house resulting from the freezing weather in early January. The pool house bathrooms were due for a maintenance upgrade in 2023. This will be performed in 2022 instead, and funded from the Reserve. An insurance claim has been submitted, and an adjuster has inspected the damage. We are waiting for a determination from our insurance.

We are getting more ballots in the mail; we are up to 36. The ballots will be opened and counted at the annual meeting.

In early January, freezing weather caused pipes to break in the pool house and in the line leading to the pool house. In the parking lot, a broken pipe was repaired and new gravel was spread. Rod reported that all the drainage systems are working well.

The pool house damages are still being assessed. We know that there are leaking pipes and some damaged wiring. There is a combination of copper and galvanized pipe in the building, and the galvanized pipe is likely original to the building. Gary Mesick made a motion that funds be made available for the replacement of all pipes in the structure if necessary. Eric Leonheart seconded the motion, and the motion passed unanimously.

Architecture: Lisa Martinez

Nineteen letters were mailed to property owners about garbage cans left in view of the street. 

We would like to thank Mark Medlin for volunteering for the architectural committee.

2021 Budget: As of January 1 2022, one household is paying dues in installments (for an additional fee). All other households are completely paid up.

As of January 1, the Operating Fund (checking) has $5455.92, and the Reserve Fund (savings) has $39,868.76.

The 2021 budget finished the year $8700 over the original 2021 budget, all of which is due to substantial legal fees, totaling more than $11,000. Since back dues have been paid this year, the budget funds received exceeded projections by about $5000, so cash flow offsets $5000 of the budget shortfall. The remainder of the shortfall was covered by the balance held in the checking account. The board expects to recover the legal fees in litigation or through an insurance claim, but this is by no means a certainty.

The community has contributed $16000 to the Reserve Fund (savings) for 2021. The community has spent $19,760 from the Reserve Fund so far this year on maintaining community property. There is enough money in Reserve to address current and projected repairs. 

2022 Budget: The draft proposed budget for 2022 holds dues at $720 per household, and it calls for $16,000 in contributions to the Reserve Fund. It raises the amount projected for legal fees by reducing other discretionary spending and by eliminating any cushion for other unforeseen expenses. A final proposal will go out to homeowners as part of the 2022 annual meeting information.

2022 Annual Meeting on February 1st–Be Sure to Vote!

Remember that the Mar Cheri Community Club’s annual All-Member meeting is Tuesday, February 1st, at 7 pm. It will be a Zoom meeting, so look for an email with instructions on how to join.

In the meantime, you will have received your ballot for the Board and for approval of the 2022 budget. Please return your ballot in advance of the meeting to ensure it is counted (as this is a Zoom meeting, there won’t be an opportunity to drop your ballot off at the door!)

Minutes for a Special Meeting of the Board of Directors of the Mar Cheri Community Club

 The board convened to discuss the appeal from a property owner regarding the action to be taken for an infraction of community rules. After consideration by the board of matters raised in the appeal, the board made its decision. The property owner will be notified by letter.

The budget is running $5000 over (the budget report shows $7600 over forecast, which includes pre-payment of November’s and December’s Reserve Fund contributions, totaling $2667, for a practical shortfall of about $5000), all of which is due to substantial legal fees, with an additional $4000 in legal fees pending board approval. Since back dues have been paid this year, the budget is exceeding projected funds received by about $4000, so cash flow is fine. The board expects to recover these legal fees in litigation, but this is by no means a certainty.

The community has contributed $16000 to the Reserve Fund (savings) for 2021. The community has spent $19,760 from the Reserve Fund so far this year on maintaining community property. There is enough money in Reserve to address current and projected repairs. 

The updated Reserve Study is complete. The community’s reserve position has improved dramatically since last year’s study. Whereas last year, the community Reserve was 23.1% fully-funded, representing a “High” risk of possible special assessments to maintain the properties, the community is now 41% fully funded, representing a “Medium” risk of possible special assessments. The Community plan calls for continued contributions of $16,000 per year, which may allow the community Reserve to become 70% fully funded by 2028, and which would represent a “Low” risk of special assessment. The total cost estimate of all components requiring maintenance in the next 5 years have a combined estimated cost of about 2 year’s Reserve funding, so should be manageable. The next items of substantial cost (pool deck replacement, pool fence, and pool resurfacing) are anticipated to be required between 2030 and 2033, by which time there should be substantial Reserve to cover the costs.

The treasurer has prepared a preliminary budget for 2022 that keeps assessments at the current level ($720), keeps Reserve funding at the current level, and budgets for higher legal fees. The legal fees are offset by a combination of reduced software costs and community members taking on the labor of opening, closing, and cleaning the pool.

Minutes for a Special Meeting of the Mar Cheri Community Board

A special meeting of the board of the Mar Cheri Community Club was called to order at 7:00 PM November 9, 2021. Directors present were: Ken Schiewetz, Eric Leonhart, Gary Mesick, Larry Barlow, and Anne Mesick.  A quorum was established.

A motion was made by Ken Schiewetz that the Board find that the Mahars’ trees are in violation of Article IX, Section 2 and Article VII, Section 1 of the Covenants. The motion was seconded by Gary Mesick.  The motion passed. The meeting was adjourned at 7:05 PM.

Minutes for a Special Meeting of the Mar Cheri Community Board

The board of the Mar Cheri Community Club was called to order at 8:00 PM November 9, 2021. Directors present were Ken Schiewetz, Eric Leonhart, Gary Mesick, Larry Barlow and Anne Mesick.

Eric, as a member of the special architectural committee, presented a letter including photographs, documenting several complaints regarding trees. Once the letter is finalized, the special architectural committee will make a recommendation to the board, and the board will have a vote on the letter.

As of October 1, there is one household that is not current on dues (late fees and interest are accruing). Four households are paying dues in installments (for an additional fee). All other households are completely paid up.

The budget is running $1100 over forecast. Since back dues have been paid this year, the budget is exceeding projected funds received by about $4000, and should cover any overrun—which is projected to be small (less than $1000), if any.


The community has contributed $12000 to the Reserve Fund (savings), and has budgeted an additional $4000 for the rest of the year. The community has spent $19,760 from the Reserve Fund so far this year on maintaining community property. There is enough money in Reserve to address current and projected repairs. 


In preparation for an update to the annual Reserve Study, the treasurer has submitted our current financial status and list of projects to the company performing the study. The study is scheduled to be updated by the end of 2021.

Meeting Called to Order at 7:06 PM September 24, 2021

Motion by Gary Mesick to go into closed executive session, pursuant to RCW 64.38.035(4), to discuss pending litigation and advice from Mar Cheri’s attorney.

Sept 2021–Minutes for the Monthly Meeting of the Board of Directors of Mar Cheri Community Club

Ken reported that the annual reserve study needs to be complete by the end of the calendar year. Gary Mesick, the treasurer, agreed and shared that it should be no problem to have his part of the work complete by the middle of October. Part of the preparation is done and he is working on a transactional log at present.

The report on the ongoing tree issue is very close to being wrapped up, but due to unforeseen issues over the Summer, the final compilation of the data collected has not happened. Vice President, Eric Leonhart, will step in to help with the completion of the project. Stay tuned.

We are so thankful for all those neighbors who volunteer, those who are helping now and those who have served in the past. Every year there are many committee positions that go unfilled, please consider volunteering to be on a committee.

As of September 1, there is one household that is not current on dues. Four households are paying dues in installments (for an additional fee). All other households are completely paid up.

As of September 1, the Operating Fund (checking) has $31398.31, and the Reserve Fund (savings) has $42,651.79.

The budget is running $2029.55 over forecast. $1334 of that is a pre-payment of September’s Reserve Fund allocation, so for practical purposes, the overrun is $695.55. Since back dues have been paid this year, the budget is exceeding projected funds received by about $4000, and should cover any overrun—which is projected to be small (less than $1000), if any.

The community has contributed $12000 to the Reserve Fund (savings), and has budgeted an additional $4000 for the rest of the year. The community has spent $19,760 from the Reserve Fund so far this year on maintaining community property, including the recently-completed rebuilding of the retaining wall north of the pool. There is enough money in Reserve to address current and projected repairs.

At long last the community mailbox is activated, and mail has been delivered to the new cluster mailbox on 2nd Avenue SW.  It is important that all of our neighbors make note that the post office box is closed and the new mailing address for the community is the street address for the pool. This address is printed in your directory.

Gary will put the services and utilities on hold until next year.

Rod reported that the pool was heavily used this Summer and that the help of those families who volunteered time to make it happen are greatly appreciated. A big thank you to Caroline and Hugh Lee, Robin Mann, Ray and Nancy Kreuger, the whole Himichuck family and Rod and Lisa Martinez. 

Rod did not need to replace the fixture in the girls’ locker room but simply needed to replace a light bulb.

The new wall at the community area is complete and looks very nice; it should serve the community well for years to come. Bark will be purchased and delivered in the Spring and we will ask for volunteers to help spread it at that time.

During the last health inspection at the pool it was noted that the depth markings on the deck of the pool must be repainted before next season.

One new request to paint a house was approved. 

Several new reports of overgrown trees blocking views were made to the architecture committee; letters will be sent to all those property owners to inform them of the violations. Lisa learned of an unauthorized shed when a property owner complained about the location of the shed. A letter of violation will go out to the property owner with the unauthorized structure. 

Preliminary plans for an addition to a home in the community have been presented. No approval has been granted, and the matter will be revisited after the City of Federal Way weighs in on the matter.

New Business:

Discussion was held about the date and location of the annual meeting for the community. The thought now is to hold the meeting the last week in January.

For planning purposes, a list of projects and purchases to be made in the new year was talked about. Gary will use the reserve study data to provide a list to Rod to aid the prioritization of the projects.

Ken shared that the special architectural committee is making progress collecting the information needed to make its recommendation to the board. There is one more property to visit before completing the report. The report should be presented at the next meeting.

Gary presented his monthly report and gave a brief explanation of how the reserve study works as a guide for planning projects in the community and as they are tracked in the budget.

The Reserve Study, required by law, is coming up in the Fall.

As of today, there is one household that is not current on dues. Four households are paying dues in installments (for an additional fee). All other households are completely paid up.

The Operating Fund (checking) has $37955.51, and the Reserve Fund (savings) has $45,080.29.

The budget is running $1300 over forecast. Most areas are under budget, with the exception of legal fees, which have exceeded the original forecast. (Last month the board approved legal expenses of up to $10,000. The original budgeted amount was $300.) Since back dues have been paid this year, the budget is exceeding projected funds received by about $4000, and should cover any overrun—which is projected to be small (less than $1000).

The community has contributed $8000 to the Reserve Fund (savings), and has budgeted an additional $8000 for the rest of the year. The community has spent $10,430.69 from the Reserve Fund so far this year on maintaining community property. Another Reserve project—rebuilding of the retaining wall north of the pool—is estimated to require another $9330 from the Reserve Fund. This is less than half the estimate built into the Reserve Study, so it may reduce the recommended amount the community would need to keep in Reserve for future maintenance and repairs to community property. There is enough money in Reserve to address current and projected repairs.

Anne reported that we are close to completing the mailbox change for delivery of the community mail. Due to the pandemic, this project has taken a long time to complete.

Rod will have a new light installed over the shower in the womens’ locker room.

One neighbor requested a new pool key card to replace a lost card. The fifty dollar fee will be collected and given to the treasurer.

Lisa submitted her report via email. There was one request for a tree to be trimmed because it is blocking a view. The tree will be trimmed in the Fall when it is a good time of year to trim trees.

New Business: 

The board recognized and welcomed the new vice president Eric Leonheart. Thank you Eric for volunteering.

Tim Kemp asked to attend the meeting and learn a bit more of how business is conducted; he is considering how he might best use his talents to volunteer in the community. Thank you Tim for joining the meeting.

The topic of overgrown trees and shrubs was once again the subject of a brief discussion at the meeting. The beautiful views that so many of us enjoy are a treasured aspect of living in Mar Cheri. We always recommend that you talk to your neighbors about any issues you are having with regard to vegetation impeding views, and work with them to resolve the issue. If that doesn’t work, please contact Lisa Martinez of the Architecture Committee and she will work with you and the property owners. Consider being proactive and asking your neighbors if any of the trees or shrubs on your property are causing a problem with their views.

We have had complaints about noise in the neighborhood. With the long days of Summer and the nice weather, conditions are right for sound to travel. The Board suggests you refer to the City of Federal way code which requires the restriction of noise from 10:00PM to 8:00AM. Thank you for being considerate of your neighbors.
