March 2026 — Minutes for the Monthly Meeting of the Mar Cheri Community Club Board of Directors

There was a quorum.

President: Ken Schiewetz

Ken submitted the geological report that was done last year to the City of Federal Way. We are awaiting the cities response to that submission.

Account Balances (as of March 1):

As of March 1, Mar Cheri had $3947.81 in the Operating account (checking) and $46477.41 in savings. Of the savings balance, $25547.41 represents Reserve funds and $20,930.00 represents Special Assessment funds.

Operations

Through February, the Community is $2000 under budget.

Note: Reserve contributions and expenses and Special Assessment income and expenses are excluded from operating results and are reported separately below, though they appear in the same ledger due to system limitations.

Reserves

There were no reserve expenses in the month of January.

Special Assessment

For the Special Assessment related to the lawsuit, the Community received $5500 in Special Assessment payments and incurred no legal expenses associated with that matter. To date, the community has spent $15220 of the $40,000 Special Assessment.

Special Assessment funds are restricted to these purposes and are not part of operating income or expenses.

Dues Status

For regular association dues:

  • 13 have paid their 2026 dues in full.
  • One household remains delinquent for dues assessed in 2022, 2024, and 2025.

2026 assessments are due in full by April 1. Late fees and interest will be applied for payments received after April 15.

For Special Assessments:

  • 50 households have paid in full;
  • 12 households are on track with their installments; andSeven households are at least one payment behind and are not in good standing
  • Three of those households have made no payments.

The final Special Assessment payment is due no later than March 15.

Anne reported that over 40 new directories have been given to residents in Mar Cheri. Directories will be given directly to residents; due to the personal information they contain, the new directories will not be left on porches. 

At Large: Larry Barlow

Larry will attempt once again to contact the source who agreed to produce the housing for the new security system at the pool and common area. If he is unable to coordinate the completion of the boxes with this person, he is working on another source.

Div 3, Lot 11

Small expansion of previously approved shed was approved.

Ongoing violations:

  • Div 1, Lot 10 
  • $75 per month for lack of maintenance (roof shingles). Balance $1050
  • $50 per month for overgrowth of weeds. Balance $300, violations remedied and fines stopped in May.
  • Div 2, Lot 2
  • $50 per month for yard and weed overgrowth. Balance $0, fines have been paid.
  • Div 4, Lot 14
  • $700 per month ($50 per tree for 14 trees) for view interference. Balance $19,600.

New Business:

Anne made a motion that the board accept a resolution to uphold, approve, sustain, and ratify the June 27 2025 letter finding the Mahar’s have violated the CC&Rs of Mar Cheri and the fines imposed. And that the board determine to continue those fines (full text of resolution attached). Gary Mesick seconded the motion. A vote was taken, and the motion passed unanimously.

Ken made a motion that members of the existing Architectural Committee with the exception of Ken Schiewetz be replaced by Gary Mesick and Anne Mesick. Such that, upon acceptance of this resolution, the Architectural Committee will now consist of Ken Schiewetz, Gary Mesick and Anne Mesick ( full text of the resolution attached).  A vote was taken, and the motion passed 3 votes to 1.

The Architectural Committee will meet at 7:30 on the second Tuesday of each month: April 14,2026, May15, 2026, June 9, 2026, July 14, 2026, August 11, 2026, Sept. 8, 2026, Oct 13, 2026, Nov. 10, 2026 and Dec. 8, 2026, Jan. 12, 2027, Feb. 9, 2027, Mar 9, 2027.

All submissions to the Architectural Committee must be submitted through PayHOA. Requests must be submitted at least 48 hours prior to the next ACC meeting. Include any applicable photos, paint color chips, sketches and or drawings. Please refer to the CC&Rs document on the website: (marcheri.org,  documents) Before starting any work on the exterior of your property it is best to check with the ACC.

A letter will arrive in the coming days with The dates and agendas for the monthly board meetings as well as the Architectural Control Committee meetings.

2026 Minutes for the Annual Meeting of the Mar Cheri Community Club

In addition to the board, there were 7 community members in attendance.

President: Ken Schiewetz

Ken Called the meeting to order at 7:07PM. 

Ken asked for two volunteers to open and count the ballots. Sherrill Miller and Makoto Sugiuchi volunteered to count the ballots.

Ken called for a moment of silence in recognition of those community members who have died in the past year: Grace and Norm Low as well as Dwayne House.

Ken thanked the many volunteers who served the community in various ways.

Ken reported that we are in a period of waiting as far as the lawsuit because the court date is in September of this year.

As of January 1, Mar Cheri had $3,232.14 in the Operating account (checking) and $50,233.79 in savings. Of the savings balance, $29,683.79 represents Reserve funds and $20,550.00 represents Special Assessment funds.

Operations

Through December (and for the calendar year 2025), operating expenses exceeded budget by approximately $10,800. This variance is largely attributable to:

  • Utilities expenses approximately $4,500 over projections; and
  • Professional fees (legal and other) approximately $7,500 over projections.

Other expense categories were under budget. In addition, the Community received approximately $4,000 more income than projected, which offset a portion of the expense overage.

Reserves

For the year, the Community deposited $7,384.09 into Reserves and incurred the following Reserve expenditures:

  • $4,270.25 for arborist services to provide a report and assessment of Community trees;
  • $1,929.26 to replace pool drains to meet county code requirements; and
  • $5,454.83 in supplies to upgrade security at the pool and picnic/play area.

Special Assessment

For the Special Assessment related to the lawsuit, the Community received $23,400 in Special Assessment payments and incurred $2,850 in legal expenses associated with that matter.

Special Assessment funds are restricted to these purposes and are not part of operating income.

Dues Status

For regular association dues:

  • 67 households have paid their 2025 dues in full;
  • One household is making installment payments; and
  • One household remains delinquent for dues assessed in 2022, 2024, and 2025.

For Special Assessments:

  • 44 households have paid in full;
  • 17 households have only the last payment remaining; 
  • Four households have fallen behind one or more payments, and
  • Four households have made no payments and are not in good standing.

The next Special Assessment payment is due no later than March 15.

Annual assessments will go out by email and regular mail following today’s meeting. They are due in full by April 1, with late fees accruing for those accounts not paid in full by April 15.

Proposed Budget (Preview)

The following summarizes the proposed budget for 2026.

The proposed budget includes the same income projections as last year. Dues will remain at $965. Most expenditure categories remain unchanged, with the following adjustments:

  • Increased allocation for utilities to reflect recent cost trends;
  • Reduced allocation for legal fees, as much of the legal expense has shifted to the Special Assessment; and
  • Increased allocation for administration to cover the cost of a new community directory.

Anne reported that in addition to keeping the minutes for all the meetings over the past year, two welcome packets were delivered to new property owners: Gage and Michelle Fishering and Dianna and Phil Porr.

Anne also reported that there is a new directory for the community, and thanked Mark Medlin for all his assistance with the project.

Ken reported the following:

  • 4 roof replacements
  • 2 paint color approvals
  • 3 solar panel approvals
  • 2 shed approvals
  • 1  atrium replacement approval
  • 1 installation of a privacy fence approved
  • 2 driveway/ patio replacements approved
  • 1 retaining wall replacement approved
  • 1 deck replacement approved

In addition to the above approvals there was a site visit by members of the Architectural Committee with the legal team to homes with view loss from overgrown trees.

There are some ongoing violations that are being monitored by the committee and our legal team.

Maintenance/Pool: Ken Schiewetz (acting chairperson)

  1. New Drain covers were installed.
  2. Drainage leak at the common area repaired
  3. Pump seal replaced
  4. New Cameras installed

5.   Pruning of trees on community property

Hospitality/Recreation: no chairperson

Nancy and Ray Krueger sponsored a Summer picnic at the common area and a cookie party in December. Thank you to the Kruegers for organizing these events.

At Large: Larry Barlow

Larry reported that we are nearly completed with the new security system at the pool.  We are awaiting two metal housing units that are a one off project( nothing that can be purchased) to be fabricated.

New Business:

There was a brief discussion about some electrical issues that have occurred in the community during the past year. It seems that as the underground wiring, under the operation of PSE, ages, there have been spotty occurences of power surges. It was a reminder to all that we need to have our property insurance policies in place and attend quickly to any abnormal electrical issues in our homes.

Vote Results:

The current board was unanimously re-elected. The budget passed with one no vote and one abstention.

There was one write in vote for Anne Mesick as the head of the Recreation Committee.

One new approval was made in the last month.

Div.1, Lot 1  is doing substantial work to the property in the coming months, and the work and proposed timeline was submitted to the Architectural Committee for review. New high-grade roofing and paint color was approved. As the project progresses, the homeowner will check back with the committee for further approvals if necessary.

Note that all exterior changes to properties in Mar Cheri need to be approved by the Architectural Committee. Thank you to all who take the important step to do this before beginning a project.

The following positions are open: Vice-president, Maintenance Chairperson, Architectural Chairperson and Recreation Chairperson. The duties of the positions are detailed in the bylaws which can be found on our website www.marcheri.org . Go to documents, By-Laws, Article X.

December 2025 — Minutes for the Monthly Meeting of the Mar Cheri Community Club Board of Directors

Ken called the meeting to order at 7 PM. 

The process of collecting all of the information for the lawsuit is happening and should be complete by the end of the year.

As of 1 December 2025, the Community had $5535.41 in the Operating account (checking) and $31020.72 in the Reserve (savings). Note that the Special Assessment will be deposited in the savings account, and will be accounted for separately than reserves during the lawsuit. As of December 1, $600 of checking (since transferred to savings) and $1200 of the savings account balance was from the Special Assessment (other payments arrived after December 1).

Through November, the Community is $8900 over budget in spending. This is largely due to professional services (lawyer, geologist, and arborist) and utilities. The Community has also received about $6300 more than budgeted in dues, which largely offsets the shortfall.

For November, there were no expenditures from Reserves. 

For November, there were no expenses from the Special Assessment.

As of December 8, 67 members have paid their 2025 dues in full. One household is making installment payments. One household has not paid dues for 2022, 2024 or 2025.

As of December 8, 19 members have paid the $600 Special Assessment in full. 10 other members have made their $150 December payment. Late fees and interest will be assessed for those households who have not made at least a $150 payment toward the Special Assessment by December 15.

Warning emails were sent to several property owners concerning garbage cans that can be seen from the street. In addition, one property owner, who is storing a recreational vehicle on their lot, was sent a warning email. The architectural committee will check on these violations and confirm compliance or will send violation notices before the January meeting.

Minutes for the November 17, 2025, Special Meeting of Mar Cheri Community Club

On November 17 2025, at the Wayside Church in Federal Way, the Mar Cheri Community Club held a special meeting of the owners to ratify the attached special assessment budget, which was approved by the Board in the total amount of $40,000.00 ($600 per lot), to fund legal fees with respect to the lawsuit filed under King County Superior Court Case No.  25-2-27162-5 KNT.

Board President Ken Schiewetz called the meeting to order at 7:05 PM. Board members present were Ken Schiewetz, Anne Mesick, Gary Mesick and Larry Barlow. Roll call of the members showed 34 homeowners present.

Ken Schiewetz made a motion to appoint James Rolf and Steve Freeborn as the Tellers Committee to Certify the Ballot Count. Gary Mesick seconded the motion. A voice vote by the membership unanimously approved their appointment.

Following an explanation of the reason for the assessment and a period for clarification and discussion by the membership, ballots were distributed to each lot represented. The Tellers Committee collected and counted the ballots, and presented the president with the following results:

27 votes to ratify the special assessment budget.

6 votes against ratification of the special assessment budget.

1 abstention.

According to Washington State law, unless lot owners to which a majority of the votes in the association are allocated reject the budget, the budget and assessments against the lots included in the budget are ratified.  Therefore, the special assessment budget is ratified and the Mar Cheri Community Club will levy a special assessment of $600 against each lot to support legal fees associated with the lawsuit.  According to the special assessment budget, the $600 special assessment is due in four equal monthly installments of $150, commencing on December 15, 2025, and continuing on the 15th day of each month thereafter (January 15th, 2026, February 15th, 2026, and March 15th, 2026).

Ken called the meeting to order at 7:00 PM.

Preparations for the lawsuit are proceeding. We have been preparing the discovery questions, and the lawyer has prepared the counterclaim. We are working with the insurance company’s legal team for our defense.

Treasurer’s Report. As of 1 November 2025, the Community had $8134.73 in the Operating account (checking) and $29819.97 in the Reserve (savings).

Through October, the Community is $11500 over budget in spending. This is largely due to professional services (lawyer, geologist, and arborist) and utilities. The Community has also received about $6000 more than budgeted in dues, which partially offsets the shortfall.

For October, there were no expenditures from Reserves. 

As of November 11, 67 members have paid their 2025 dues in full. One household is making installment payments. One household has not paid dues for 2022, 2024 or 2025.

Ken Schiewetz made a motion that the board vote to amend the October 2025 Board meeting minutes (meeting occurred on September 29, 2026), as follows.

  1. Ken Schiewetz made a motion to approve the attached special assessment budget, which would result in a special assessment of $600.00 per lot, for the purpose of paying for legal fees to pursue counterclaims and defend the action brought against Mar Cheri Community Club by Laurance Mahar.

Anne Mesick seconded the motion.

A vote was taken and the motion passed approving the special assessment budget.

2. Ken Schiewetz made a motion to call a special meeting of the members of the Mar Cheri Community Club to be held on Monday, November 17, 2025 for the purpose of holding special assessment budget ratification vote.

Gary seconded the motion.

A vote was taken and the motion passed to call a special assessment ratification meeting on Monday, November 17, 2025.

Ken learned from Neal Tripp that the pool pump has been resealed and the leak is gone.

Treasurer’s Report. As of 28 September 2025, the Community had $12478.69 in the Operating account (checking) and $29818.47 in the Reserve (savings).

Through September, the Community is $10000 over budget in spending. This is largely due to professional services (lawyer, geologist, and arborist) and utilities. The Community has also received about $4000 more than budgeted in dues, which partially offsets the shortfall.

For September, there were no expenditures from Reserves. 

As of September 28, 67 members have paid their 2025 dues in full. One household is making installment payments. One household has not paid dues for 2022, 2024 or 2025.

Ken made a motion that $900.00 be approved to replace the pump seal at the pool. Gary Mesick seconded the motion. A vote was taken and the motion passed.

One new request was made of the Architectural Committee since the last meeting;

  • Div. 4, Lot 7- new exterior paint.

No new violations were issued in September.

Ongoing violations:

  • Div.1, Lot 10
  • $75.00 per month for lack of maintenance (roof shingles) continues. Balance $975.00.
  • $50.00 per month for overgrowth of weeds. Balance $300.00, violations remedied and fines stopped in May.
  • Div. 3, Lot 2
  • $50.00 per month yard and weed overgrowth. Balance $0 as fines have been paid.
  • Div. 4, Lot 14
  • $700.00 per month ($50 per tree for 14 trees) for view interference. Balance $16,100.

New Business:

Motion made by Ken Schiewetz to go into executive session (7:10 PM), pursuant to RCW 64.38.035(4) to discuss pending litigation and advice from Mar Cheri’s attorney.

Motion seconded by Gary Mesick. 

A vote was taken and the motion passed.

Ken Schiewetz made a motion to approve the attached special assessment budget, which would result in a special assessment of $600.00 per lot, for the purpose of paying for legal fees to pursue counterclaims and defend the action brought against Mar Cheri Community Club by Laurence Mahar. 

Anne Mesick seconded the motion. 

A vote was taken and the motion passed approving the special assessment budget.

Ken Schiewetz made a motion to call a special meeting of the members of the Mar Cheri Community Club to be held on Monday, November 17, 2025 for the purpose of holding special assessment budget ratification vote.

Gary Mesick seconded the motion.

A vote was taken and the motion passed to call a special assessment budget ratification meeting on Monday, November 17, 2025.

A letter, containing more information about the meeting, will be mailed to property owners.

A welcome packet was delivered to Phil and Dianna Porr. The Porr’s purchased property Division 4, Lot 7. Welcome to our new Mar Cheri neighbors.

At Large: Larry Barlow

Larry reported that most of the new lock system at the pool and play area near the pool is installed and working. There are one or two things that need to be addressed before the new key cards can be formatted. Larry said that the end of the project is in sight.

Ken shared that the pool is now shut down for the season. He, and the board would like to thank all those members who volunteered to help at the pool in any capacity to make it a fun and successful season. Thank you to Robin Mann, Anna Himichuk, James Rolf, Nancy Krueger, Heather Pierce, Olga Mendoza, Kay Gomez, Jody Hanson, Wayne Miller, Laurel Kelso, and Neal and Ruth Tripp.

Without your help we wouldn’t have been able to keep the pool going.

No new requests were granted since the August meeting.   Gary Zukowski submitted his resignation due to medical concerns from his recent bicycle accident.  Mar Cheri HOA Board thanks Gary for his time on the Board and wishes him a full recovery from his injuries.

Current members of the committee:   Ken Schiewetz (Acting Chair), Wes Bekele, and Heather Pierce.

August 2025–Minutes for the Monthly Meeting of the Mar Cheri Community Club Board of Directors

Ken called the meeting to order at 7:05 PM.  

The in-person meeting for the Reserve Study took place, and Ken met with Greg, who did the site inspection. This Study, required by the state, is intended to list and inspect the physical property which the community owns. A report on the condition of that property, the life expectancy of the property and an estimated cost to replace or repair is then issued.

For July, there was one expenditure from Reserves. $4270.25 was paid to Infinity Tree Service for the first phase of trimming trees on the common property near the pool. 

As of August 11, 67 members have paid their 2025 dues in full. One household is making installment payments. One household has not paid dues for 2022, 2024 or 2025.

The Community picnic was attended by about 20 people. Thank you to Nancy and Ray Krueger who organized the event and donated the hotdogs and hamburgers. All those families who attended brought food to share which made for quite a feast. We had a fun afternoon, and it was great to get together after a long COVID hiatus.

Maintenance/Pool: Ken Schiewetz (acting chairperson)

Ken gave Larry Barlow’s report on the status of the pool entry system. Both card readers are installed and are be tested. Once those readers are set the new key cards can be formatted and issued. Clare Bruce and Larry are doing the finishing work on the new gate latches. After this weekend, the project should be very close to being complete.

Ken gave the report for the Architectural Committee.

The following Architectural Requests were submitted and approved since the last meeting:

  • Div 4, Lot 11     Installation of roof solar panels.
  • Div 4, Lot  5     Replacement of existing driveway.
  • Div 1, Lot 19     Permission to erect a small shed in the eastern part of the lot.

No new architectural violations were issued. 

Ongoing violations, balances reflected are through Aug 12, 2025.

This a reminder to store all garbage and recycle cans out of street view.
